iPad Drawing Rules

iPad Drawing period:

Starts April 15, 2024, and ends June 30, 2024. OFFER IS NOT VALID IN CONJUNCTION WITH ANY OTHER OFFERS OR PROMOTIONS.

iPad Recipient Eligibility:

The iPad drawing is open to legal residents of the continental USA who are 18 years of age or older. Each member who enters into the drawing of an iPad from Orlando Credit Union must be a member in good standing with Orlando Credit Union.

By entering this drawing, entrants accept and agree to be bound by these Official Rules and the decisions of Orlando Credit Union. Orlando Credit Union employees, officials, directors, and members of their immediate families are not eligible to participate in the drawings. “Immediate family” is defined as including parents, spouses, children, siblings, or any members of the same household.

iPad Recipient Rules governing iPad selection and disbursement:

One iPad recipient will be drawn each month on the 1st day of the month during the drawing period beginning April 15 and ending June 30, 2024. iPads may not be transferred, redeemed for cash, or substituted by/with the Recipient with/by/from Orlando Credit Union.

iPad Rules to enter drawing:

  • One member may enter the drawing one time during the creation of a new membership and a new checking account.

  • Legal residents of the continental USA who are 18 years of age or older may enter the drawing by choosing to mail in an entry for the iPad drawing as no purchase or payment of any kind is necessary to enter. Mailed in entries must be submitted on an 8.5x11 piece of paper with:

    • Full legal name, legal address, a daytime phone number for contact, a current e-Mail address.

    • All mailed entries must be received by the last day of the month during the drawing period: April 30, May 31, June 30.

If a write-in entry form or card is drawn, but an Orlando Credit Union employee(s) is unable to determine the recipient because of illegible writing, that entry form or card will be disqualified. No copies, mechanical reproductions, or metered mail accepted. Mail-in entries must be received by the end of each month to be eligible for the monthly drawing. Proof of mailing does not constitute proof of delivery. Orlando Credit Union is not responsible for lost, late, incomplete, misdirected, damaged, postage due, or illegible entries or mail. Once submitted, entries become the sole property of Orlando Credit Union and will not be acknowledged or returned.

iPad Recipient selection:

Each drawing entrant has an opportunity to be selected as an iPad recipient. To be selected as an iPad recipient, a member must enter the drawing to win an iPad. The iPad recipient is randomly selected from entries. The odds of being selected for an iPad from those entered the drawing are based on the number of entrants.

Liability/General Rules:

Orlando Credit Union is not responsible for any loss which may occur in connection with the drawing. The Entrant agrees to hold the Orlando Credit Union harmless from any liability arising from participation in the drawing or the acceptance, receipt, possession, or misuse of the iPad. Orlando Credit Union and each of its officers, directors, employees, members, and representatives and agents are not responsible for any negligence, claims, liability, injury, property loss, or other damages of entrants and/or recipients arising from, or in connection with, acceptance, receipt, possession, or use/misuse of iPads awarded or participation in this drawing. Orlando Credit Union is not responsible for any incorrect or inaccurate information, whether caused by tampering, hacking, or by any of the equipment or programming associated with the drawing. An iPad may not be substituted, converted to cash, assigned, or transferred by recipients. Orlando Credit Union reserves the right to substitute an iPad of equal or greater value should the featured iPad become unavailable for any reason. Orlando Credit Union reserves the right to disqualify entrants who fail to follow these Official Rules and regulations or who make any misrepresentations relative to the drawing and redemption of an iPad.

iPad Recipient notification:

Recipients are notified by telephone or email from Orlando Credit Union within 3 business days from the completion of a drawing. Phone number and/or email contact information will be provided on a member’s membership application or through a mailed in drawing submission for entry into the drawing. Recipients will receive their iPad through mail service to the official address as marked on their membership application or mailed in drawing submission or by making arrangements to pick up the iPad in-person from the nearest branch location.

Orlando Credit Union does not assume responsibility for incorrect/inaccurate drawing entry information/ maintenance of said information or of any and all maintenance of the iPad product offered.

List of iPad Winner(s) / Official Rules Requests:

To receive the name of the winners or a copy of the Official Rules, send a stamped self-addressed envelope after the drawing period to: Orlando Credit Union, c/o Marketing Department, 945 South Orange Avenue, Orlando, FL 32806.

Monetary Tax:

For non-cash prizes or awards the value must equal or exceed $600 to file a 1099-MSC. The value of each iPad awarded during this promotion does not meet the minimum required amount to file 1099-MSC therefore Orlando Credit Union is not responsible for reporting to the IRS. Drawing recipients are responsible for reporting any monetary and/or non-monetary prize earnings under federal and state regulations.

Publicity Authorization:

The iPad recipient agrees to permit Orlando Credit Union to utilize his/her name and likeness in promotional and other Credit Union materials, without additional compensation or permission, except where prohibited by law.

Choice of Law:

All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrant and Orlando Credit Union in connection with the Drawing, shall be governed by, and construed in accordance with, the substantive laws of the State of California, USA, without regard to choice of law rules.

ARBITRATION: NOTICE OF BINDING ARBITRATION AGREEMENT:

You and we agree to attempt to informally settle any disputes arising out of or connected with this drawing or any prizes awarded. If that cannot be done, you and we agree that any dispute arising out of or connected with this drawing will be resolved by BINDING ARBITRATION administered by the American Arbitration Association (“AAA”) in accordance with its Commercial Dispute Resolution Procedures and Supplementary Procedures for Consumer Related Disputes. You thus GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend your rights under these Official Rules (EXCEPT FOR CLAIMS BROUGHT INDIVIDUALLY WITHIN SMALL CLAIMS COURT JURISDICTION, SO LONG AS THE CLAIM REMAINS IN SMALL CLAIMS COURT). Your rights will be determined by a NEUTRAL ARBITRATOR and NOT a judge or jury. You are entitled to a FAIR HEARING, BUT the arbitration procedures are SIMPLER AND MORE LIMITED THAN RULES APPLICABLE IN COURT. Arbitrator decisions are as enforceable as any court order and are subject to VERY LIMITED REVIEW BY A COURT. The place of arbitration shall be in the County in which you reside. Any claims and defenses that can be asserted in court can be asserted through arbitration. The arbitrator shall be entitled to award the same remedies that a court can award, including PUBLIC INJUNCTIVE RELIEF to the extent available under the CALIFORNIA UNFAIR COMPETITION LAW AND CONSUMER LEGAL REMEDIES ACT. Discovery shall be available for non-privileged information to the fullest extent permitted under the Rules. The arbitrator’s award can be entered as a judgment in court. Any ARBITRATION under these Official Rules WILL BE ON AN INDIVIDUAL BASIS. You understand and agree that YOU ARE WAIVING THE RIGHT TO PARTICIPATE AS A CLASS REPRESENTATIVE OR CLASS MEMBER IN A CLASS ACTION. If YOU PREVAIL on the merits of your claim in arbitration, ORLANDO CREDIT UNION WILL PAY YOUR ATTORNEYS’ FEES. You will NOT be required to pay ORLANDO CREDIT UNION’S ATTORNEYS’ FEES IF ORLANDO CREDIT UNION PREVAILS. This NOTICE OF BINDING ARBITRATION AGREEMENT shall be interpreted and enforced in accordance with the Federal Arbitration Act set forth in Title 9 of the U.S. Code to the fullest extent possible, notwithstanding any state law to the contrary, regardless of the origin or nature of the claims at issue.
